Effective Date: 1 May 2026<\/p>\n

1. Introduction<\/h2>\n

1.1 These Terms & Conditions (\u2018Terms\u2019) apply to all purchases and use of digital content provided by The Banner of Truth Trust and its affiliated entities.<\/p>\n

1.2 By purchasing, downloading, streaming, or accessing any Digital Content, you agree to be bound by these Terms.<\/p>\n

1.3 If you do not agree, you must not purchase or access Digital Content.<\/p>\n

2. Definitions<\/h2>\n
    \n
  • \u2018We\u2019, \u2018us\u2019, \u2018our\u2019 means:\n
      \n
    • The Banner of Truth Trust (SC038435 \/ 235652)<\/strong> \u2013 a charity registered in Scotland and in England and Wales<\/li>\n
    • BANNER OF TRUTH (EIN: 23-1672774)<\/strong> \u2013 a US 501(c)(3) tax-exempt organisation serving North America (United States, Canada, and Mexico)<\/li>\n<\/ul>\n<\/li>\n
    • \u2018Digital Content\u2019 means eBooks, audio files, magazines, conference addresses, and any other digital media provided electronically or via the App or website.<\/li>\n
    • \u2018App\u2019 means the official Banner of Truth mobile application for iOS and Android.<\/li>\n
    • \u2018Licence\u2019 means the limited rights granted to you to access and use Digital Content under these Terms.<\/li>\n<\/ul>\n

      3. Contracting Entity<\/h2>\n

      3.1 Your contract is formed with the entity responsible for your purchase, which will be:<\/p>\n

        \n
      • The Banner of Truth Trust (SC038435 \/ 235652)<\/strong>, for UK and international purchases via banneroftruth.org\/uk; or<\/li>\n
      • BANNER OF TRUTH (EIN: 23-1672774)<\/strong>, for purchases made in the United States (including its territories), Canada, and Mexico via banneroftruth.org\/us.<\/li>\n<\/ul>\n

        3.2 The contracting entity will be identified at checkout.<\/p>\n

        4. Licence Grant<\/h2>\n

        4.1 All Digital Content is licensed, not sold.<\/p>\n

        4.2 Upon purchase, you are granted a non-exclusive, non-transferable, revocable licence for personal, non-commercial use only.<\/p>\n

        4.3 You may:<\/p>\n

          \n
        • Access Digital Content on devices you personally own or control;<\/li>\n
        • When available, download eBooks where applicable for offline personal use;<\/li>\n
        • Access App Content via supported iOS or Android devices.<\/li>\n<\/ul>\n

          4.4 Access is limited to you and permitted household members (see clause 6).<\/p>\n

          5. Supported Formats & Platforms<\/h2>\n

          5.1 Digital Content may be provided as:<\/p>\n

            \n
          • eBooks: downloadable EPUB, MOBI or via the Digital App;<\/li>\n
          • Other Digital Content: via the Digital App<\/li>\n<\/ul>\n

            5.2 Compatibility<\/p>\n

            5.2.1 We do not guarantee compatibility with all devices, operating systems, or third-party software.<\/p>\n

            5.2.2 You are responsible for ensuring that your device and software are capable of accessing the Digital Content in the format provided.<\/p>\n

            5.3 Access to Digital Content is provided under licence and may be modified, updated, reformatted, or discontinued where reasonably necessary for legal, technical, security, licensing, or operational reasons. We will take reasonable steps to ensure continued access to Digital Content that has been validly licensed by you, where practicable.<\/p>\n

            5.4 App Dependency<\/p>\n

            Where Digital Content is provided via the Digital App:<\/p>\n

              \n
            • access is dependent on continued availability of the App on supported platforms (iOS and Android); and<\/li>\n
            • we do not guarantee ongoing availability of the App on any specific device, operating system, or app store.<\/li>\n<\/ul>\n

               <\/p>\n

              6. Household Use<\/h2>\n

              6.1 Permitted Household Access<\/p>\n

              You may share access to Digital Content, on devices you own, with immediate members of your household only, defined as:<\/p>\n

                \n
              • your spouse or civil partner; and<\/li>\n
              • your children under the age of 18.<\/li>\n<\/ul>\n

                Such access is permitted solely for personal, non-commercial use.<\/p>\n

                6.2 Device and Access Restrictions<\/p>\n

                Digital Content may only be accessed on devices that are:<\/p>\n

                  \n
                • owned by you; or<\/li>\n
                • owned and controlled by members of your household as defined in clause 6.1.<\/li>\n<\/ul>\n

                  Where Digital Content is provided as downloadable files (e.g. eBooks), such files must remain on devices under your or your household\u2019s control and must not be transferred outside that household.<\/p>\n

                  6.3 Simultaneous Use<\/p>\n

                  Access to Digital Content may be subject to technical limitations, including restrictions on simultaneous use across multiple devices or accounts.<\/p>\n

                  We reserve the right to implement reasonable controls to ensure compliance with these Terms and to protect licensing integrity.<\/p>\n

                  7. Prohibited Uses<\/h2>\n

                  You must not, and must not permit others to:<\/p>\n

                    \n
                  • Sell, rent, lease, distribute, or sublicense Digital Content<\/li>\n
                  • Share content outside permitted household use<\/li>\n
                  • Upload or make content publicly available<\/li>\n
                  • Modify, translate, adapt, or create derivative works<\/li>\n
                  • Remove or bypass DRM, watermarks, or access controls<\/li>\n
                  • Use content in libraries, institutions, or lending systems<\/li>\n
                  • Extract, scrape, or reuse content in other works<\/li>\n
                  • Use automated tools to copy or download content<\/li>\n<\/ul>\n

                    All rights not expressly granted are reserved.<\/p>\n

                    8. Device Management<\/h2>\n

                    8.1 If you sell or transfer a device, you must remove all licensed Digital Content from it.<\/p>\n

                    8.2 You are responsible for preventing third-party access via transferred devices or accounts.<\/p>\n

                    9. App Store & Google Play Terms<\/h2>\n

                    The Banner of Truth App does not process payments and does not offer in-app purchases. All Digital Content purchases must be made via our website before they can be accessed via the App.<\/p>\n

                    The App is only for accessing free and purchased Digital Content.<\/p>\n

                    10. Restore Purchases<\/h2>\n

                    10.1 You may access previously purchased Digital Content in the App by signing into your App account using the same account used at the time of purchase.<\/p>\n

                    10.2 Regional Availability<\/p>\n

                    Due to licensing and distribution restrictions, the availability of Digital Content may vary by territory.<\/p>\n

                    Certain Digital Content may be restricted or unavailable in some countries or regions outside the country or jurisdiction in which the purchase was made.<\/p>\n

                    11. Consumer Rights<\/h2>\n

                    11.1 Nothing in these Terms affects your statutory rights under applicable consumer law, including:<\/p>\n

                      \n
                    • Consumer Rights Act 2015 (UK)<\/li>\n
                    • Consumer Contracts Regulations 2013 (UK)<\/li>\n
                    • Applicable US state and federal consumer protection laws (where relevant)<\/li>\n<\/ul>\n

                      12. Digital Content Cancellation Rights<\/h2>\n

                      12.1 Statutory Right to Cancel<\/p>\n

                      Where you are a consumer, you have a statutory right to cancel your purchase within 14 days of the contract being formed, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, subject to the exceptions set out below.<\/p>\n

                      12.2 Loss of Cancellation Right for Digital Content<\/p>\n

                      You acknowledge that your statutory right to cancel will be lost once:<\/p>\n

                        \n
                      • the supply of Digital Content begins (including downloading, streaming, or accessing the content); and<\/li>\n
                      • you have expressly consented to immediate supply; and<\/li>\n
                      • you have acknowledged that you will lose your right to cancel once supply begins.<\/li>\n<\/ul>\n

                        12.3 Confirmation of Consent<\/p>\n

                        At the point of purchase, you will be required to confirm that:<\/p>\n

                          \n
                        • you request immediate supply of the Digital Content; and<\/li>\n
                        • you understand that this will result in the loss of your 14-day cancellation right.<\/li>\n<\/ul>\n

                          12.4 Statutory Rights<\/p>\n

                          Nothing in these Terms affects your statutory rights in relation to:<\/p>\n

                            \n
                          • faulty or misdescribed digital content under the Consumer Rights Act 2015; or<\/li>\n
                          • any other rights which cannot legally be excluded.<\/li>\n<\/ul>\n

                            13. Refunds & Faulty Content<\/h2>\n

                            13.1 We will ensure Digital Content is:<\/p>\n

                              \n
                            • As described<\/li>\n
                            • Of satisfactory quality<\/li>\n
                            • Fit for purpose<\/li>\n<\/ul>\n

                              13.2 If Digital Content is faulty, you are entitled to a remedy under applicable law, which may include:<\/p>\n

                                \n
                              • Repair or replacement; or<\/li>\n
                              • Refund where repair or replacement is not possible<\/li>\n<\/ul>\n

                                13.3 We are not responsible for issues caused by:<\/p>\n

                                  \n
                                • Device incompatibility<\/li>\n
                                • Third-party platform restrictions<\/li>\n
                                • User error or account misuse<\/li>\n<\/ul>\n

                                  14. Availability & Access<\/h2>\n

                                  14.1 We do not guarantee uninterrupted availability of Digital Content.<\/p>\n

                                  14.2 Content may be modified, updated, or withdrawn where necessary for legal, technical, or licensing reasons.<\/p>\n

                                  15. Account Security<\/h2>\n

                                  15.1 You are responsible for maintaining account confidentiality.<\/p>\n

                                  15.2 You must not share login credentials.<\/p>\n

                                  15.3 We may suspend access if misuse or breach is suspected.<\/p>\n

                                  16. Intellectual Property<\/h2>\n

                                  16.1 All intellectual property rights remain with The Banner of Truth Trust, Banner of Truth, or their licensors.<\/p>\n

                                  16.2 No rights are granted except as expressly stated in these Terms.<\/p>\n

                                  17. Limitation of Liability<\/h2>\n

                                  17.1 Nothing excludes liability for:<\/p>\n

                                    \n
                                  • Death or personal injury caused by negligence<\/li>\n
                                  • Fraud or fraudulent misrepresentation<\/li>\n
                                  • Any liability that cannot be excluded under law<\/li>\n<\/ul>\n

                                    17.2 We are not liable for:<\/p>\n

                                      \n
                                    • Indirect or consequential loss<\/li>\n
                                    • Loss of data<\/li>\n
                                    • Device or platform incompatibility<\/li>\n
                                    • Third-party service failures<\/li>\n<\/ul>\n

                                      18. Termination<\/h2>\n

                                      18.1 We may suspend or terminate access if you breach these Terms.<\/p>\n

                                      18.2 Upon termination, your licence ends immediately, and you must delete all copies of Digital Content.<\/p>\n

                                      19. Governing Law<\/h2>\n

                                      19.1 These Terms are governed by:<\/p>\n

                                        \n
                                      • The laws of England and Wales (for UK entity contracts), or<\/li>\n
                                      • The laws of the relevant US state (for US entity contracts), as applicable.<\/li>\n<\/ul>\n

                                        19.2 Courts of the relevant jurisdiction shall have exclusive jurisdiction.<\/p>\n

                                        20. Changes to These Terms<\/h2>\n

                                        20.1 We may update these Terms from time to time.<\/p>\n
